1. Agreement to Terms

By accessing this website or enrolling in services provided by iCan STEM Learning LLC (“Company,” “we,” “us,” or “our”), you agree to be legally bound by these Terms & Conditions.

If enrolling a minor, you represent and warrant that you are the parent or legal guardian and agree to these Terms on the minor’s behalf.

2. Description of Services

We provide academic support including but not limited to:

  • One-on-one tutoring (online and in-person)

  • Small group tutoring

  • Instant/on-demand tutoring

  • STEM enrichment classes

  • Test preparation

  • Academic coaching

Services may be modified, suspended, or discontinued at our discretion.

3. Payment Terms

  • Payment is required prior to session unless otherwise agreed in writing.

  • Packages are non-transferable.

  • Prices may change with notice.

  • Failure to remit payment may result in suspension of services.

We reserve the right to use third-party payment processors.

4. Cancellation & Rescheduling Policy

  • Cancellations must be made at least 24 hours in advance.

  • Late cancellations or no-shows may result in forfeiture of the session.

  • Emergencies may be considered at our discretion.

  • If we cancel, a makeup session or refund will be provided.

5. Refund Policy

  • Completed sessions are non-refundable.

  • Digital products and materials are non-refundable.

  • Unused prepaid sessions may be refunded at our discretion, minus administrative fees.

6. Instant Tutoring Terms

Instant tutoring sessions are defined as on-demand sessions scheduled within short notice.

By booking instant tutoring:

  • You acknowledge tutor availability is not guaranteed.

  • Payment is due immediately upon booking.

  • Cancellations for instant sessions are non-refundable.

  • Technical issues on the client’s end do not qualify for refunds.

  • Sessions begin at the scheduled time regardless of late arrival.

7. In-Person Tutoring Liability Waiver

By participating in in-person tutoring sessions, you acknowledge and agree:

  1. You voluntarily assume all risks associated with attending in-person sessions.

  2. iCan STEM Learning LLC is not responsible for injuries, accidents, property damage, or loss occurring during sessions unless caused by gross negligence.

  3. Parents/guardians are responsible for safe transportation to and from tutoring locations.

  4. The Company is not liable for incidents occurring outside scheduled session times.

To the fullest extent permitted under Florida law, you agree to release, waive, and hold harmless iCan STEM Learning LLC, its owners, employees, and contractors from any claims, liabilities, damages, or expenses arising from participation in services.

8. Health & Safety (In-Person)

Parents/guardians agree:

  • Students will not attend sessions if experiencing contagious illness.

  • The Company may implement health policies as deemed necessary.

9. Online Tutoring & Technology Disclaimer

Clients are responsible for:

  • Reliable internet access

  • Functional devices

  • Proper learning environment

We are not liable for interruptions caused by third-party platforms (Zoom, Google Meet, etc.).

Recording sessions without written consent is prohibited.

10. Intellectual Property

All materials, curriculum, worksheets, branding, logos, content, and methodologies are the exclusive property of iCan STEM Learning LLC.

You may not reproduce, distribute, or share materials without written consent.

11. Academic Performance Disclaimer

We do not guarantee:

  • Specific grades

  • Test scores

  • School placements

  • Academic outcomes

Student progress depends on effort, attendance, and external factors beyond our control.

12. Limitation of Liability

To the maximum extent permitted under Florida law:

  • Our total liability shall not exceed the amount paid for services in the previous 30 days.

  • We are not liable for indirect, incidental, or consequential damages.

13. Indemnification

You agree to indemnify and hold harmless iCan STEM Learning LLC from any claims resulting from:

  • Misuse of services

  • Violation of these Terms

  • False information provided during enrollment

14. Governing Law & Venue

These Terms shall be governed by and construed under the laws of the State of Florida.

Any disputes shall be resolved in courts located in Broward County, Florida.

15. Severability

If any provision of these Terms is found invalid under Florida law, the remaining provisions shall remain enforceable.

16. Changes to Terms

We reserve the right to update these Terms at any time. Continued use constitutes acceptance of revisions.
